1. Who we are

Guild ("we", "us", "Guild") is operated by Berlinexperiences DMC UG, registered at Gotlandstraße 10, 10439 Berlin, Germany. Full company details are listed in our Imprint. You can reach us at hello@guild.guide.

2. What Guild is — and isn't

Guild is a vetted directory and communication platform for working tour guides and tour operators. Through Guild, members can list themselves in a directory, post and respond to job opportunities, exchange direct messages, and participate in community forums.

Guild is not a travel agency, tour operator, package travel provider, or employer. We do not sell, broker, arrange, deliver, or guarantee any tour, booking, employment, or service performed by a member. We do not handle payments between members or their customers. Any agreement to perform or purchase a tour, or to engage a guide, is concluded directly and exclusively between the parties involved, on their own terms.

Listings, job posts, forum content, and messages are created by members, not by Guild. We do not verify the accuracy of member-supplied content beyond the application-stage vetting described in our Privacy Policy.

3. Eligibility and accounts

Guild membership is currently invitation-based: prospective members apply via guild.guide/apply, and a city administrator reviews each application before issuing credentials. You must be at least 18 years old and legally entitled to perform paid guide or tour-operator work in the city you list as your base city.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@guild.guide if you suspect unauthorised use.

4. Subscriptions and payments

Guild is a paid service. Membership tiers and current prices are listed on guild.guide/upgrade and in the app. All prices are quoted in euros and include applicable VAT where shown.

Subscriptions are processed by Stripe Payments Europe Ltd. on our behalf. Stripe's terms apply to the payment transaction itself. We do not store full payment-card details on Guild servers.

Weekly subscriptions renew automatically each week until cancelled. Annual subscriptions are paid in advance for a twelve-month period and renew automatically at the end of that period unless cancelled before renewal. You can cancel at any time from the app or from the Stripe customer portal; cancellation takes effect at the end of the current billing period and no further payments will be charged.

In-app purchases of one-off products (for example a "Bump" or an additional weekly job post) are processed by Apple or Google through their respective stores and are subject to their refund policies in addition to the rights described below.

5. Right of withdrawal (consumers, EU)

If you are a consumer resident in the European Union, you have a statutory right to withdraw from a distance contract within 14 days of its conclusion without giving any reason. For digital services such as a Guild subscription, you can exercise this right by emailing hello@guild.guide with a clear statement of withdrawal. We will refund any payments received using the same payment method, within 14 days of receiving your statement, unless you have explicitly requested that performance of the service begin during the withdrawal period and acknowledged that you lose the right of withdrawal once performance has fully begun.

By using Guild after sign-in, you confirm that you wish the service to begin immediately and acknowledge that the right of withdrawal lapses to the extent the service has been performed.

6. Member content

You retain ownership of the content you submit — your profile text, photos, forum posts, job descriptions, and messages ("Member Content"). By submitting Member Content, you grant Guild a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit that content to other users of the service for the purpose of operating Guild. This licence ends when you delete the content or your account, subject to backups and legal-retention obligations described in our Data Retention Policy.

You warrant that you own or have the necessary rights to all Member Content you submit, that it does not infringe any third party's rights, and that it complies with our Acceptable Use Policy.

7. Acceptable use, moderation, and removal

Use of Guild is subject to our Acceptable Use Policy, which forms part of these Terms. We may remove content, suspend accounts, or terminate membership without notice where content or conduct breaches the AUP, applicable law, or these Terms.

Reports of illegal content, copyright infringement, or community violations can be submitted in-app via the report menu on any post or message, or by email to reports@guild.guide. See our DSA Notice & Action procedure for the timeline and process we follow.

8. Termination

You may close your account at any time from the in-app Settings → Privacy → Delete account screen. Account closure deactivates your profile immediately and triggers permanent deletion of personal data within 30 days, subject to retention obligations described in our Data Retention Policy.

We may suspend or terminate your access if you breach these Terms, the Acceptable Use Policy, or applicable law, or if continued access poses a credible risk to other members or to the integrity of the service. Where the breach is remediable we will give you reasonable notice and an opportunity to cure unless immediate action is necessary.

9. Disclaimers

Guild is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We make no warranty about the accuracy, completeness, or reliability of Member Content, the suitability of any member for any engagement, or the outcome of any agreement reached between members.

10. Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under the applicable law.

Subject to the paragraph above: our total liability arising out of or in connection with the service in any twelve-month period is limited to the greater of (a) the fees you have paid to Guild in that period, or (b) one hundred euros. We are not liable for indirect, incidental, or consequential losses, or for loss of profit, revenue, business, goodwill, or data.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to members by email at least 30 days before they take effect, and members may terminate their subscription within that period if they do not accept the change. Continued use of Guild after the effective date constitutes acceptance.

12. Governing law and venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. The exclusive place of jurisdiction for any dispute arising out of or in connection with these Terms is Berlin, Germany, insofar as the user is a merchant, a legal entity under public law, or a special fund under public law. Mandatory consumer protections of the law of the user's country of residence remain unaffected.

13. EU online dispute resolution

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
