Why this exists

1. Parties

This Agreement is between you (the "Guide") and Berlinexperiences DMC UG, Gotlandstraße 10, 10439 Berlin, Germany ("Guild").

2. Membership

The Guide Membership is the standard tier for working tour guides on Guild. It includes:

  • A profile in the verified directory of your base city.
  • Posting and replying in the city forum.
  • End-to-end encrypted direct messaging with other members.
  • Access to the jobs board, including responding to operator-posted jobs.
  • One job post per week of your own (additional weekly posts may be purchased in-app).
  • Field warnings, weather, and operational feed for your city.
  • Push notifications for priority jobs and direct mentions.

3. Price

The Guide Membership is offered at the following prices, all in euros and inclusive of any applicable VAT:

  • Weekly: €1.00 per week, billed weekly via Stripe, auto-renewing until cancelled.
  • Annual: €40.00 per year, billed annually in advance via Stripe, auto-renewing until cancelled. Net effective rate ≈ €0.77 per week.

We may adjust prices with at least 30 days' written notice to you. If you do not accept a price change, you may cancel before it takes effect and will not be charged the new rate.

4. You are an independent professional

Nothing in this Agreement creates an employment, agency, partnership, or joint-venture relationship between you and Guild. You decide what tours you offer, what you charge, when you work, which customers and operators you accept, and which jobs you respond to. Guild does not control your schedule, set your prices, or take a commission on any engagement.

You are solely responsible for your own tax registration, invoicing to your customers, social-security contributions, and any business permits or guide-licensing required in your city. Guild is not your employer and does not withhold tax or social contributions on your behalf.

5. Member content and warranties

By submitting content to Guild — your profile, photos, posts, messages — you warrant that:

  • You own that content or have a clear right to use it on Guild.
  • It is accurate and not misleading.
  • It complies with our Acceptable Use Policy and applicable law.
  • It does not infringe any third party's rights, including copyright, trademark, privacy, or personality rights.

You retain ownership of your content. You grant Guild the licence described in §6 of the Terms of Service to host and display it.

6. Cancellation, refunds, and withdrawal

You can cancel your subscription at any time from the Settings → Membership screen or from the Stripe customer portal. Cancellation takes effect at the end of the current billing period (the next week, for weekly; the end of the paid year, for annual). No further payments are charged after cancellation; we do not pro-rate refunds for the current period except where required by law.

Right of withdrawal: if you sign up as a consumer resident in the European Union, you have 14 days from the day you concluded the Agreement to withdraw without giving any reason. To exercise the right, email hello@guild.guide with a clear statement of withdrawal. By using Guild after sign-in, you confirm that you wish the service to begin immediately and acknowledge that the right of withdrawal lapses once the service has been fully performed.

7. Suspension and termination by Guild

Guild may suspend or terminate your membership for material breach of this Agreement, the Acceptable Use Policy, or applicable law. Where the breach is remediable we will give you reasonable notice and an opportunity to cure unless immediate action is necessary to protect other members or the integrity of the service. If we terminate without cause, we will refund the unused portion of your current billing period on a pro-rata basis.

8. Data and privacy

Personal data is processed as described in our Privacy Policy and kept for the durations set out in our Data Retention Policy. You can export or delete your data at any time from the in-app Settings → Privacy screen.

9. Liability

Guild's total liability under or in connection with this Agreement is limited as set out in §10 of the Terms of Service. Nothing in this Agreement limits liability that cannot be limited under applicable law.

10. Governing law

This Agreement is governed by German law. The place of jurisdiction is Berlin, subject to mandatory consumer protections of the law of your country of residence.
